GDPR sanctions: the first precautionary measure in Germany Our life with the new GDPR will no longer be the same: in fact, for those who manage online projects nowadays, they must comply with the new European regulation on sensitive data which came into force last May 26th (but with an exception for Italy until August ). We experienced the first case of application of the regulation abroad and it could only be in Germany, where the laws are strictly enforced. But let's see what happened. As we learn from the Altalex website and other online blogs, the Regional Find Your Phone Number Court of Bonn has issued a precautionary measure against the American company ICANN ( Internet Corporation for Assigned Names and Numbers) based in Los Angeles, in relation to the collection procedure of data relating to the " whois ", i.e. the network protocol that allows the querying of database servers in order to establish which internet provider the IP address belongs to and obtain sensitive data, such as name, personal data, residence, registration date of the domain.
Specifically, ICANN, the international management body that coordinates the Internet identification system worldwide through the attribution of domain names and IP addresses, on May 17, in view of the entry into force of the rules of the aforementioned GDPR, issued its own " Temporary Specification for gTLD Registration Data" - specifying the quantity, methods and terms of duration of data storage and ordered EPAG Domainservices GmbH based in Bonn, a domain registrar company, to adapt to its new rules. However, the Court of Bonn rejected the request promoted by ICANN, applying the principle of minimization of the data collected, specifying that ICANN must know and verify only the data of the domain holder, who is solely responsible towards ICANN and therefore not the data of the third parties who deal with purely technical roles.
